DWC Policies

The Michigan Mental Health Code (MHC) section 330.1752 mandates the establishment of written policies and procedures concerning recipient rights and the operation of the office of recipient rights. The code further mandates that the policies and procedures shall provide a mechanism for prompt reporting, review, investigation, and resolution of apparent or suspected violations of the rights guaranteed by chapters 7/7A of the MHC. The policies shall be consistent with these chapters, and shall be designed to protect recipients from, and prevent repetition of, violations of code protected rights.

Abuse & Neglect

To indicate and identify the appropriate actions that must be taken when there are allegations of violations abuse and neglect.

Change in Type of Treatment

To provide standards to be followed to ensure that recipients receiving Authority-contracted services are involved and informed of the treatment plan and/or support plan developed as the Individual Plan of Service using a person-centered planning process, including changes in treatment.

Communication & Visits

To provide standards to be followed to ensure that recipients receiving Authority-contracted service have unimpeded, private and uncensored communication with others by email and telephone and to visit the persons of his or her choice.

Complaint Resolution

To ensure any investigation of alleged rights complaints will be performed in a manner that protects the rights of all parties involved and all reports of investigative findings will meet standards to assure timely and effective resolution of substantiated rights violations.

Comprehensive Examinations

Consent to Treatment & Services

To provide standards to be followed to ensure informed consent is obtained from the recipient or their legal representative and documented in writing prior to the receipt of mental health services.

Disclosure of Confidential or Privileged Information

To provide policy direction to ensure that information in the record of a recipient, and other information acquired in the course of providing mental health services to a recipient, shall be kept confidential, shall not be open to public inspection, and shall be disclosed only in the circumstances and under the conditions set forth in law and in this policy.

Family Planning

To provide standards to be followed to ensure that recipients of Authority-contracted services have information regarding health and family planning services.

Fingerprinting, Photographing, Audio-Taping, Use of One-Way Glass

To provide policy direction for fingerprinting, photographing, audio-taping, or viewing through one-way glass, of a recipient.

Freedom of Movement

To provide standards to be followed to ensure that recipients of Authority-contracted services shall not have their freedom of movement restricted more than is necessary to provide mental health services, prevent injury or prevent substantial property damage.

Medication Procedures

To provide policy direction for the Authority, MCPN's, contractors, and their subcontractors to ensure that medication shall be prescribed, dispensed, administered, and monitored in a safe manner with established standards of practice.

Recipient Rights Appeals

The purpose of this policy is to establish policy direction for handling appeals of Recipient Rights summary reports to assure all recipients and those acting on their behalf are afforded due process including its essential elements of notice and an opportunity to be heard by a fair and impartial decision-making entity.

Resident Labor

Right to Entertainment Materials, Information & News

To provide policy direction to ensure that recipients of Authority-contracted/subcontracted services shall not be prevented from obtaining, at personal expense, reading/viewing/listening material.

Use of Restraint

Use of Behavior Treatment in Community Mental Health Settings

This policy is intended to give direction to the required Behavioral Treatment Plan Review Committees to appropriately oversee access to and implementation of behavior treatment techniques.

Use of Psychotropic Drugs

To provide policy direction for Authority MCPNs contractors and their subcontractors to ensure that psychotropic drugs shall be prescribed, subject to signed written informed consent by a qualified licensed physician and shall be limited to the treatment of substantiated disorders of mood, thought and behavior.

Use of Seclusion
